With all of the buzz in the news this week about the Supreme Court of the United States hearing oral arguments on the constitutionality of the Affordable Care Act, it is notable that HIPAA and HITECH come from completely different legislation which predate the ACA.
HIPAA itself refers to The Health Insurance Portability and Accountability Act of 1996. For information on HIPAA and Health Information Privacy, see http://www.hhs.gov/ocr/privacy/
HITECH is The Health Information Technology for Economic and Clinical Health Act which amended Title XXX of the Public Health Service Act by adding a number of funding opportunities to advance health information technology.
